Alternative Dispute Resolution
1.1 These General Terms and Conditions (hereinafter referred to as “GTC”) of Natural production s.r.o. (hereinafter referred to as “Seller”) apply to all contracts for the supply of goods concluded between a consumer or entrepreneur (hereinafter referred to as “Customer”) and the Seller in connection with goods presented by the Seller on the online trading platform www.Kaufland.sk (hereinafter referred to as “Kaufland.sk”). The inclusion of the Customer’s own terms and conditions is hereby objected to unless otherwise agreed.
1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity.
1.3 An entrepreneur within the meaning of these GTC is a natural or legal person or a company with legal capacity who acts in the exercise of their commercial or self-employed professional activity when concluding a legal transaction.
2.1 The product descriptions displayed on Kaufland.sk do not constitute binding offers by the Seller but serve as an invitation for the Customer to submit a binding offer.
2.2 The Customer can submit their offer via the online order form on Kaufland.sk. After placing the selected goods in the virtual shopping cart and completing the electronic ordering process, the Customer submits a legally binding offer to conclude a contract for the goods contained in the shopping cart by clicking the button that completes the order process.
2.3 The Seller may accept the Customer’s offer within five days by:
Sending a written order confirmation or confirmation in text form (fax or email), in which case receipt of the confirmation by the Customer is decisive, or
Delivering the ordered goods to the Customer, in which case receipt of the goods by the Customer is decisive, or
Requesting payment from the Customer after placing the order.
If multiple alternatives apply, the contract is concluded when the first of these alternatives occurs. The acceptance period starts on the day after the Customer submits their offer and ends at the end of the fifth day following the submission. If the Seller does not accept the Customer’s offer within this period, the offer is considered rejected, and the Customer is no longer bound by their declaration of intent.
2.4 The Seller stores the contract text and sends it to the Customer in text form (e.g., email, fax, or letter) after submitting the order along with these GTC and Customer information. Beyond this, the Seller does not provide access to the contract text.
2.5 Before submitting the binding order, the Customer can detect input errors by carefully reviewing the information displayed on the screen. A useful technical means for better recognizing input errors can be the zoom function of the browser, which enlarges the display on the screen. The Customer can correct their entries during the electronic ordering process using standard keyboard and mouse functions until they click the button to complete the order process.
2.6 The contract language is exclusively Slovak.
2.7 Order processing and communication take place via email and automated order processing. The Customer must ensure that the email address provided for order processing is correct so that emails sent by the Seller can be received. Especially when using spam filters, the Customer must ensure that all emails sent by the Seller can be delivered.
3) Right of Withdrawal
3.1 Consumers generally have the right to withdraw from the contract.
3.2 Further information on the right of withdrawal can be found in the Seller’s withdrawal policy.
4.1 The prices quoted by the Seller are total prices and include statutory value-added tax. Any additional shipping and delivery costs are listed separately in the respective product description.
4.2 The available payment methods are provided in the Seller’s product description.
4.3 Payment processing is handled on behalf of the Seller by cflox GmbH, Große Brunnenstrasse 122, 22763 Hamburg, Germany. Cflox GmbH may use other payment service providers, which will be disclosed to the Customer in the payment information on Kaufland.sk.
5.1 Goods are delivered to the delivery address specified by the Customer unless otherwise agreed. The delivery address stated during the order processing on Kaufland.sk is decisive for transaction processing.
5.2 If delivery is unsuccessful due to reasons attributable to the Customer, the Customer bears the reasonable costs incurred by the Seller. This does not apply to return costs if the Customer effectively exercises their right of withdrawal.
5.3 The Seller reserves the right to withdraw from the contract in case of incorrect or improper self-supply. This applies only if the Seller is not responsible for the non-availability and has concluded a specific covering transaction with due diligence. In case of unavailability or partial availability of goods, the Customer will be informed immediately, and any payments will be refunded promptly.
If the Seller makes advance payments, they retain ownership of the delivered goods until the purchase price has been paid in full.
7.1 Unless otherwise stipulated, statutory liability provisions apply.
7.2 If the Customer is an entrepreneur, different liability provisions apply.
The applicable law depends on whether the Customer is a consumer or entrepreneur, as described in section 1.
